NICVA’s response to DETI’s consultation paper on a ‘Community Interest Company’ (CIC)(March 2004)

Summary :

NICVA welcomes the introduction of a new legal structure which has been designed specifically for social economy enterprises that want to use their profits and assets for the good of the public.

Currently social enterprises operate within a variety of different legal forms, namely companies limited by guarantee,industrial and provident societies, andsomecharities.

It is proposed that the CIC would be created within the company law framework, combining the company model with a community benefit test and a simple and transparent mechanism to lock profits into the company.

NICVA broadly welcomes many of the proposals butis cautious about the Regulator for Northern Ireland being based in Great Britain.
